These Terms and Conditions ("Terms") govern your use of our website, e-commerce store, and the purchase of our products, including our built-in FASD medical alert bracelets/Necklaces.

 

By accessing our website or purchasing our products, you agree to be bound by these Terms and all applicable Canadian federal and provincial laws.

 

1. Business Identity and Location

FASD Assist operates proudly out of **Ontario, Canada**. All services, digital products, and physical e-commerce transactions are managed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

 

2. E-Commerce Purchases and Billing

Pricing:

All prices displayed on our website are in Canadian Dollars (CAD) unless stated otherwise. Prices are subject to change without notice.

Taxes:

Purchases are subject to applicable Canadian federal and provincial sales taxes (including HST where applicable) based on your shipping destination.

Order Refusal:

We reserve the right to refuse or limit any order you place with us. This includes orders that appear to be placed by dealers, resellers, or unauthorized distributors.

 

 3. Shipping and Delivery (Canada Post & Regional Carriers)

Risk of Loss:

All physical items purchased from our e-commerce store are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the package to Canada Post or our designated regional shipping carrier.

Delivery Timelines:

Estimated shipping dates are subject to carrier availability and are not strictly guaranteed.

 

4. Critical Medical Disclaimer (Alert Bracelets)

Identification Tool Only:

Our built-in FASD medical alert bracelets/necklaces are designed strictly as a visual aid to communicate conditions to first responders, teachers, and caregivers. 

No Medical Liability:

FASD Assist does not provide medical advice, diagnosis, or treatment. The physical bracelet/necklace does not guarantee specific emergency response times, nor does it guarantee specific third-party actions in an emergency. 

User Responsibility:

It is the responsibility of the caregiver to ensure the information on or linked to the bracelet/necklace remains accurate and that the bracelet/necklace is securely fastened.

 

 5. Intellectual Property

All content included on our website and e-commerce platform including text, graphics, graphics files, logos, images, digital downloads, interface layouts, and software is the property of FASD Assist and is protected by Canadian and international copyright laws.

 

6. Consumer Protection Compliance

These Terms explicitly respect and incorporate the statutory rights of consumers under the Ontario Consumer Protection Act. If any provision within these Terms is found to be invalid or unenforceable by an Ontario court of law, that specific provision will be severed, and the remaining terms will remain in full force and effect.

These Terms and your use of our e-commerce platform shall be governed exclusively by the laws of the Province of Ontario, Canada, and the federal laws of Canada.
