FASD Assist ("we", "us", or "our") operates the FASD Assist mobile application (the "App") and our e-commerce store (the "Website"). We are committed to protecting the privacy and personal data of caregivers and the youth they support. 

 

This Privacy Policy explains how we collect, use, disclose, and safeguard your information in strict compliance with Canadian federal and provincial privacy laws, including the **Personal Information Protection and Electronic Documents Act (PIPEDA)** and Ontario's **Personal Health Information Protection Act (PHIPA)** where applicable to consumer-health contexts.

 

1. IMPORTANT NOTICE REGARDING YOUTH AND HEALTH DATA

Because our App is designed to assist individuals with Fetal Alcohol Spectrum Disorder (FASD) and other neurodiversities, the data you input regarding a youth may include sensitive personal health information. 

Express Consent:

By creating an account and entering information about a youth, you declare that you are the legal parent or lawful guardian of that youth and explicitly consent to our collection and processing of their data as outlined in this policy.

Control:

You retain full ownership and control over this data and can edit or permanently delete it at any time through the App settings.

 

2. INFORMATION WE COLLECT

A. Information Provided Voluntarily by Caregivers

Account Information:

Name, email address, password, and account tier selection.

Youth Profiles:

First name or initials, age, daily routines, visual schedules, and behavioral or sensory tracking logs that you choose to input.

E-Commerce Data:

Billing address, shipping address, and payment information (processed securely through third-party PCI-DSS compliant payment gateways) required to fulfill purchases of our physical medical alert bracelets.

 

B. Information Collected Automatically

App Usage Data:

Crash logs, device operating system version, and general interaction metrics to help us optimize app stability and performance. We do not track your precise GPS location.

 

3. HOW WE USE YOUR INFORMATION

We use the collected information strictly to provide and improve our services:

To host, display, and manage your caregiver dashboard, routines, and youth profiles.

To process, package, and ship physical medical alert bracelets purchased on our website.

To facilitate the Service Provider connection, but *only* if you explicitly authorize and link your account to a specific community worker, clinic, or organization.

To provide technical troubleshooting and customer support.

We **never** sell, rent, or trade your personal data, nor the data of the youth you support, to third parties or advertising networks.

 

4. DATA STORAGE AND CANADIAN RESIDENCY

All personal, health, and profile data entered into the FASD Assist App is **stored securely on cloud servers located within Canada**. This ensures your data remains protected under Canadian legal jurisdictions and privacy safeguards.

 

5. DATA SECURITY AND PROTECTION

We implement robust administrative, technical, and physical security measures to safeguard your information against loss, theft, unauthorized access, modification, or disclosure:

Encryption:

Data transmitted between the App/Website and our servers is encrypted using Secure Socket Layer (SSL/TLS) technology, and sensitive database fields are encrypted at rest.

Access Control:

Access to database records is restricted to authorized personnel who require the data solely for technical maintenance or service delivery.

 

6. SERVICE PROVIDER LINKS AND SHARING DATA

Our App features a paid **Service Provider Tier** designed for community organizations.

Caregiver Control:

A Service Provider *cannot* see any information about your youth unless you manually approve a connection and explicitly link your caregiver account to them.

Revoking Access:

You can disconnect from a Service Provider at any moment through the App settings, which instantly revokes their access to your youth's live data dashboard.

 

7. YOUR RIGHTS UNDER CANADIAN LAW

Under PIPEDA and Ontario privacy standards, you have the following rights regarding your data:

Right of Access:

You can request a copy of all personal data we hold about you or your registered youth.

Right to Correction:

You can update or correct any inaccuracies directly inside your profile settings.

Right to Deletion (The Right to be Forgotten):

You can request the permanent deletion of your account. Deleting your account completely purges all associated youth routine data and history from our live databases.

 

8. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect functional updates or legal modifications. We will notify you of any significant changes via an in-app alert or an email notice before the changes take effect.
